The www.slidetiles.com website (the "Site" or, "Slidetiles", "Website") is comprised of various web pages operated by The Gutsy Group LLC ("we" or, "Gutsy Group", "The Gutsy Group", "our", "us"). www.slidetiles.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of www.slidetiles.com services ("Services") constitutes your agreement to all such Terms, all applicable laws and regulations. Please read these terms carefully, and keep a copy of them for your reference. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

The Gutsy Group LLC allows customers to upload images, they have the rights to reproduce or personally own, to our website ("Website") so that we may print those images onto metal tiles ("Slidetile" or "Tile(s)").

Your use of www.slidetiles.com is subject to The Gutsy Group's Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

Use License

By using the Services, you represent and warrant that (a) all information you submit is truthful and accurate; (b) you are 18 years of age or older, have your parent's or guardian's permission to enter into these Terms, or otherwise have the ability to form a binding contract; (d) your use of the website or Services does not violate any applicable law or regulation or any obligation you may have to a third party; (e) your use of the Website and Services shall be in compliance with all applicable laws and regulations; and (f) you are solely responsible for obtaining the consent of the parent or guardian ("Parental Consent") before transferring us any information, including images, of any children.

You may use the Website and the Services in accordance with and subject to these Terms. Slidetiles may, at its sole discretion and at any time, modify or discontinue, temporarily or permanently, any part of the website or the Services without notice. Slidetiles shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Services.

Slidetiles may, for any reason, at its sole discretion and without notice, discontinue or refuse to provide you with the Website or Services. Grounds for such refusal may include but are not limited to (i) violation of the letter or spirit of these Terms, (ii) fraudulent, harassing or abusive behavior, (iii) behavior that is illegal or harmful to other users, third parties, or the business interests of Slidetiles, (iv) breach of your representations and warranties herein or breach of any of the terms of these Terms, or (vi) use of your chargeback rights with your credit card company or denial or dispute of any preapproval obtained by Slidetiles from your credit card company.

If we believe, at our sole discretion, that a violation of these Terms or any illegal or inappropriate behavior has occurred, we may take any other corrective action we deem appropriate. We reserve the right to investigate suspected violations of these Terms or illegal and inappropriate behavior on the Website. We will fully cooperate with any law enforcement investigation or court order requesting or directing us to disclose the identity, behavior or (User) Content (as defined below) of anyone believed to have violated these Terms or to have engaged in illegal behavior in connection with the Website and/or the Services.

Any suspension, termination, or cancellation of Services shall not affect your obligations to Slidetiles under these Terms (including but not limited to ownership, indemnification, limitation of liability and payment obligation), nor will it affect any other terms herein, which by their sense and context are intended to survive such suspension, termination, or cancellation.

Your Account

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that The Gutsy Group is not responsible for third party access to your account that results from theft or misappropriation of your account. The Gutsy Group and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.

Third Party Accounts

You will be able to connect your Slidetiles account to third party accounts. By connecting your Slidetiles account to your third party account, you acknowledge and agree that you are consenting to the continuous release of information about you to others (in accordance with your privacy settings on those third party sites). If you do not want information about you to be shared in this manner, do not use this feature.

Limitations

In no event shall The Gutsy Group LLC or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on The Gutsy Group LLC's website, even if The Gutsy Group LLC or an authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

Your Responsibility

It is your responsibility to use Slidetiles and any equipment supplied with each tile responsibly and in a safe manner. The Gutsy Group is not liable for any damage to property or persons that may arise due to the use of Slidetiles or any other product sold on www.slidetiles.com. Such damages include but are not limited to: damage to customer’s walls, damage to customer’s property or injury to customer or anyone related to the customer. Upon purchasing products from www.slidetiles.com you waive all rights to pursue liability claims due to the use of Slidetiles or any other products found on www.slidetiles.com.

Arbitration

In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

Governing Law

These terms and conditions are governed by and construed in accordance with the laws of California and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

Refunds

If you are not completely satisfied with your order due to a mistake we have made or because your SlideTile(s) arrived damaged, you may request a refund by emailing us at hello@slidetiles.com and sending us a picture of the damaged SlideTile(s). We will not refund any amounts if your dissatisfaction with the Tile(s) is due to a mistake on your part.

Satisfaction Guarantee

Our Satisfaction Guarantee policy lasts for 15 days from the day you receive your order in the mail. If you are not 100% satisfied with your order, you may request a return via our contact us form or send an email to hello@slidetiles.com. We handle all returns on a case by case basis. If a refund is given, the buyer shall cover the return shipping costs, which will be deducted from the refunded amount.

International transfers of personal information

The personal information we collect is stored and processed in United States, or where we or our partners, affiliates and third-party providers maintain facilities. By providing us with your personal information, you consent to the disclosure to these overseas third parties.

Data Collection from Google Photos™

Our website, https://slidetiles.com, uses the Google Photos API to query your images in drive.readonly scope (“Read access only. List items from the library and all albums, access all media items and list albums owned by the user, including those which have been shared with them.”). This scope is “Sensitive”, that means that we need to follow a certain Google API Services: User Data Policy and our Oauth consent screen was verified my Google.

Through the Google Photos API, we are able to access items from the library and all albums, access all media items and list albums owned by the user, including those which have been shared with them.

Only the images you choose are uploaded to our server at which point they are permanently deleted after a certain period of time.

The purpose of the use of the Google Photos API is to give our customers the ability to upload their images saved in their Google Photos account for printing onto our products. We will never share, distribute or sell the images uploaded by our customers. All data
